Owner:

  • Please be advised that per the Building Code: 780 CMR 102.8.1 Owner Responsibility; The owner shall be responsible for compliance with the code.
  • Know the contents of your property file, review file at the Building Department if possible or request a copy for your reference through a public record's request.
  • Important:
    • The owner should contact the authorized licensed contractor, remember the permit's applicant is responsible to close their specific building permit.
    • See Town Code (Chapter 1, Article 2) for possible penalty for building code violation.
    • Many building permits have related plumbing, gas, or electrical permits.
    • Open plumbing, gas, or electrical permits MUST be addressed by and closed out by licensed professionals only, and with the appropriate Town Inspector.
Following the Owners good work to comprehend the status of their property file:
  • Direct the permit holder to contact the building department in writing to continue the process, which may or may not include an appeal of the Building Official's response.
What if the permit holder is unable to close their building permit?
  • Then, the owner may submit to the Building Department their narrative and propose their code based resolution to this Building Code violation.
  • You may want to seek professional building code and/or legal advice in preparing your narrative.
