Absentee vs. Early Voting

In Massachusetts, absentee voting is available in all elections, while early voting only in certain elections. The two systems overlap in several ways, but the most important difference is that absentee voters must have an excuse, while there is no excuse needed in order to vote early.

Voters who are unable to vote on Election Day may vote by absentee ballot because of:
Absence from the town while the polls are open
    Physical disability
    Religious belief

Applying for a Ballot

Any mail-in ballot (early voting or absentee) must be requested in writing by 5 p.m. on the 5th business day before the election. Your application can only be accepted if it has reached your local election office by the deadline.

Applications can be submitted by mail, email, or fax. If you are emailing your application, you may either scan or take a photo of your signed application and email it to your local election office.  Please be sure to sign the application, and typed signatures are not acceptable.

Emergency Absentee Ballots

A voter admitted to a health care facility after 12:00 p.m. on the 7th day before the election can request a hand-delivered absentee ballot.  The person you designate to deliver your ballot will need to bring the signed application to your local election office, may be allowed to pick up your absentee ballot, bring it to you, and return it for you by the close of polls on Election Day.  Emergency ballots may be requested up until the close of polls.

Returning your Ballot

Ballots may be returned by mail or in person to town hall or in the secure tax drop box located at Town Hall..  If you are delivering your ballot by hand during business hours of the Town Building, please bring the ballot to the Town Clerk's office.

Ballots must reach the Clerk's Office by the close of polls on Election Day in order to be counted.  Ballots can not be dropped off at poll locations.

What happens to my voting status if I don't return my Annual Town Census?

While returning your census does not register you to vote, failure to respond shall result in removal from the active voting list.  The inactive voters will be placed on the inactive voters list and will be sent a confirmation post card,  The confirmation notice must sign and return in order to convert back to an active voter. The confirmation notice is meant to confirm that the voter continues to reside at the address at which he or she is registered, or if the voter has moved, update the address on file. Voters who fail to return confirmation notices will remain on the inactive voters list.

Inactive Voters

On Election Day, If you are an inactive voter, you will be on the Inactive Voter List when you check-in at your polling place.  Before you may vote, you will be required to show identification and complete an affirmation of current and continuous residence.  The identification must reflect the voter's name and address as it appears on the Inactive Voter List.  It is not required that you present photo identification. Acceptable forms of identification include: a driver's license, state-issued ID card, recent utility bill, rent receipt, lease, a copy of a voter registration affidavit, or any other printed identification which contains your name and address.  Inactive voters may still cast a ballot, if you have moved within Wayland, or have moved from one Massachusetts municipality to another within six months of a state election.

Returning to Active Voter

Inactive voters remain registered to vote until they fail to vote in two consecutive biennial state elections. Inactive voters are restored to the active voters list any time they return a Census form, complete an affirmation of current and continuous residence, fill out a new voter registration form, sign a nomination form/petition or submit anything to their local election official which is signed under penalty of perjury and confirms the voter's address.

If the census form received is accurate, sign and return to the Town Clerk's Office by mail within 10 days of receipt.  If updates need to be made, please make the necessary changes, sign and return it.  If you've moved into Wayland after the 1st of January and would like to establish residency, please complete a Census Form to include you and members of your household or register to vote.

HOW TO AVOID BEING "INACTIVE"

1) Always respond to the Annual Listing of Residents (also known as the Annual Resident Census).  Annual Census forms are usually mailed to residents early January every year.

2) Vote every opportunity you have the chance!

3) Whenever you move make sure to register to vote at your new address.

The Census is conducted in accordance with Massachusetts General Laws in every city and town in the Commonwealth of Massachusetts. By taking a moment to respond, the Town Clerk’s Office is able to keep your voter history and voting address up to date, even if you may occasionally miss the opportunity to vote.  Your name will be removed from the voting list if you have not voted in two federal elections.
